What is important for a property buyer in Germany?

Let's start with the most important question: can a Pole easily buy real estate in Germany?

Olga Martin, real estate broker in Berlin: Yes, in principle in Germany, a foreigner, regardless of nationality, can purchase real estate. There is no law restricting the possibility of a citizen of another EU country buying real estate in Germany. The buyer must only be 18 years of age, but this also applies to German citizens.

What should we know when buying real estate?

 

OM: Buying an apartment is undoubtedly a serious investment in our lives. It is not only a decision that will often consume all your savings, but at the same time it is the fulfillment of the biggest dream of your own home.  That is why it is worth approaching the purchase of an apartment with appropriate preparation. After finding your dream apartment, it is important to check the legal status of the property. This is a very important point that cannot be forgotten.

Access to the land and mortgage register will give us certainty that the property is not burdened with debts and that the person selling it to us is the legally valid owner. Sometimes it happens that an apartment can be owned by several people and the sale will require the consent of all owners.  

​

The German land and mortgage register also includes information on property encumbrances. For example, if we buy a house, there may be a provision saying that we have to pay our neighbor a toll each year as a result of using the road on his land that leads to our building.  We will also find information about all loans taken out for real estate.

Since Polish and German civil law are different from each other, it is worth using the advice of a professional real estate broker who will help us understand the specifics of the market in order to avoid unpleasant and costly consequences.  

 

For example, in Poland, in principle, an agreement is drawn up in the form of a notarial deed that transfers the ownership of the property, while only sometimes a preliminary agreement is drawn up that obliges the conclusion of the first agreement. There is only one contract in Germany which is a combination of both. Thus, the contract for the sale of real estate contains two parts: a contract for the transfer of ownership of the real estate (Kaufvertrag) and an act of disposition (the so-called Auflassung) having a material effect in the form of the transfer of ownership to the buyer.  

 

The presence of an interpreter, if the notary does not know the foreign language himself, is obligatory. In addition, buyers or sellers who do not speak German have the right to translate not only an oral but also a written notarial deed into their mother tongue. 

What are the additional costs when buying a property in Germany?  

 

OM: When buying real estate, in addition to the purchase price of a house or apartment, we must also take into account additional costs. These fees often differ from state to state in Germany, so you should read them before you decide to buy.

 

For example, it is the buyer who bears the costs of the notary (Notarkosten) and the entry in the land register (Grundbuchkosten). This is related to the obligation to notarize the purchase of real estate in Germany.  These costs amount to approx. 1.5% of the purchase price, of which approx. 1% are notary costs, and 0.5% - the costs of the land and mortgage register. If, for example, we assume that the price of a property in Berlin that must be notarized is EUR 300,000, then approximately EUR 4,500 will be spent on notary and land registration costs.  

 

In addition, the purchase of real estate is subject to a real estate tax (Grunderwerbsteuer), which is paid by the purchaser. The basis for the calculation is the purchase price, on which, depending on the state of Germany, real estate tax is payable in the amount of 3.5% to 6.5%. This tax belongs to the additional purchase costs and should therefore be included in the financial plan when purchasing real estate.

If we decide to help a real estate broker, you also have to remember about this cost. The average rates of real estate agencies in Berlin are 3.57% (including VAT) of the purchase price. Finally, where is it worth looking for offers?

 

OM: Many people are looking for offers on internet portals, such as ImmobilienScout24 or Immowelt, where we can find an apartment ourselves.  However, in the German market it is difficult to buy an apartment without a specialized real estate agency, so it is worth contacting them directly to get the offers you are interested in first hand before they appear online.
